1. Agreement to these Terms
These Terms of Service ("Terms") are a binding agreement between you and Aging Sidekick ("Aging Sidekick," "we," "us," "our") governing your use of our website and the Aging Sidekick application (together, the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy and Consumer Health Data Privacy Notice. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 18 years old and able to form a binding contract to use the Service. The Service is for adults acting as family caregivers.
3. What the Service is
Aging Sidekick is an AI assistant built for family caregivers. The Service helps you organize and prepare, and may include voice intake, assessment templates, Life Plans, analysis of documents, audio, and photos you provide (for example a discharge summary, a visit recording, or a photo of a medication), an AI assistant, and curated answers that cite vetted public and medical sources. Features and limits depend on your plan and may change.
4. Not medical advice; you are interacting with AI
This section is important. Please read it.
- **Aging Sidekick is not a medical provider and does not provide medical,
nursing, diagnostic, or treatment advice. It helps you organize what your loved one's care team has already told you and prepare better questions for the next visit. It does not diagnose, and it complements — it does not replace — your loved one's healthcare team.** Medication changes belong with the prescriber.
- The Service is not for emergencies. If you think someone may be in danger
or needs urgent care, call your local emergency number or contact a healthcare professional. Do not rely on the Service for emergency, urgent, or time- critical needs.
- You are interacting with an AI assistant — not a human. We disclose this
at the start of an AI session and on request. AI output can be incomplete or wrong; you are responsible for how you use it and should confirm anything important with a qualified professional.
- No outcomes are promised. We do not guarantee any health, safety,
caregiving, or other outcome from using the Service.
5. Your account
You are responsible for the accuracy of your account information, for keeping your credentials secure, and for activity under your account. Tell us promptly if you suspect unauthorized use.
6. Acceptable use
You agree not to:
- use the Service for any unlawful, harmful, or abusive purpose;
- rely on the Service for emergency, diagnostic, or treatment decisions;
- upload information you do not have the right to share, or that infringes
others' rights;
- attempt to reverse engineer, scrape, overload, or interfere with the Service
or its security;
- use the Service to build a competing product or to train a machine-learning
model;
- misrepresent your identity or your authority to act for another person.
7. Your content and the information you provide
You keep ownership of the content you provide ("Your Content"), including information about your loved one. You grant us a limited license to host, process, and use Your Content solely to operate and provide the Service to you, including to generate the outputs you request. We do not sell Your Content and we do not use Your Content to train AI models. You are responsible for having an appropriate basis to share another person's information with us. See the Privacy Policy and Consumer Health Data Privacy Notice for details, including export and deletion.
8. AI outputs
Outputs the Service generates from your inputs are provided to help you organize and prepare. They are informational only, may be inaccurate or incomplete, and are not professional advice. You are responsible for reviewing outputs and deciding how to use them, and for confirming anything important with a qualified professional.
9. Plans, billing, and cancellation
The Service may offer a free tier and one or more paid plans. Current plans, features, limits, and prices are shown in the Service. Paid plans renew for successive terms unless cancelled before the renewal date. You can cancel at any time; cancellation stops future charges and takes effect at the end of the current paid term. Except where required by law, payments are non-refundable. Payment processing is handled by a third-party processor.
10. Intellectual property
The Service, including its software, design, text, and branding, is owned by Aging Sidekick or its licensors and is protected by law. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended caregiving purpose. You may not copy, modify, distribute, or create derivative works of the Service except as allowed by these Terms or applicable law. Feedback you send us may be used without obligation to you.

The Service relies on third-party providers and may reference or link to third-party sources and websites. We are not responsible for third-party content, products, or practices. Cited sources are provided for your information and do not imply endorsement by, or partnership with, those sources.
12. Disclaimers
Except where prohibited by law, the Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any output is accurate, complete, or suitable for your situation. The Service is not a substitute for professional medical, legal, financial, or other advice, and we promise no particular outcome.
13. Limitation of liability
To the maximum extent permitted by law, Aging Sidekick and its affiliates, officers, employees, and providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, or goodwill, arising from or related to the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the 12 months before the event giving rise to the claim (or, if you paid nothing, a nominal amount). Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
14. Indemnification
You agree to indemnify and hold Aging Sidekick harmless from claims and costs arising out of your misuse of the Service, your violation of these Terms, or your violation of another person's rights, including in connection with information you provide about another person.
15. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate access if you violate these Terms or to protect the Service or its users. On termination, your right to use the Service ends; sections that by their nature should survive (for example, content license limitations, disclaimers, limitation of liability, and dispute resolution) survive.
